Indexation
Epidemics, wars, and global crises bring about inflation and price increases. In such situations, long-term contracts can cause financial losses for contractors and subcontractors. Indexation is a mechanism for adjusting the value of agreements between parties.
Under the current public procurement law, indexation is mandatory for contracts lasting longer than 6 months. In contracts between private entities, indexation may be introduced under the civil code (e.g., articles 357¹ and 632 of the civil code). In case of lack of agreement on indexation in the contract, the party affected by inflation has the right to a legal claim for modification or termination.
