Arbitration
Arbitration is a method of dispute resolution utilizing a private tribunal. Arbitral tribunals are divided into permanent and ad hoc. Permanent arbitral tribunals typically operate within institutions dedicated to specific industries (e.g., construction - SIDIR). Permanent arbitral tribunals have established rules, fee schedules, and other procedural guidelines. Ad hoc arbitral tribunals are tribunals established by the parties exclusively to resolve individual disputes. They operate according to the will of the parties and the arbitrator(s). Parties and arbitrators can freely determine procedural rules and costs of the process.
Arbitration results in a decision or a settlement. An award from an arbitral tribunal carries the same force as a judgment from a court of general jurisdiction. It requires confirmation by a court of general jurisdiction through the granting of an enforcement clause. it can be enforced by a bailiff and other executive authorities.
