Tender proceedings

A significant portion of construction work is carried out through public procurement. The primary method of selecting a contractor for public procurement is through a tender. Tendering is conducted in accordance with the public procurement law, which defines the procedural rules and conditions for participating in a tender.

The tender procedure itself can be rather complex. The strict requirements of equal treatment of contractors by contracting authorities mean that minor mistakes by a contractor can result in their exclusion from the process. However, decisions made by the contracting authority are not final, and there is a right of appeal to the National Chamber of Appeals (KIO) and to the general court.

We assist our clients in resolving doubts related to preparing tender offers. We analyze the completeness of our client's offer and, if necessary, the validity of competitors' offers. We provide advice in drafting documents during the tender process (e.g., offer clarifications, explanations for extraordinarily low prices) and in filing appeals to KIO and the court.
