Negotiations
Negotiations are a fundamental means of resolving claims between parties. A properly documented and justified claim, along with a well-chosen negotiation strategy, often allows for avoiding litigation. Especially claims submitted to a public contracting authority must be suitable for consideration in the context of public fund management principles. The success of negotiations should result in an amendment to the agreement or a settlement. Often, negotiations concern the content of the amendment or settlement, even when the parties have agreed on the substance of the claim.
