Claims against developers

The nature of developer agreements to some extent makes customers dependent on the developer, who acts as an investor in the construction process. The customer's interests are determined by the signed agreement and the information prospectus, which define property parameters such as area, quality of work, and completion time. The developer's failure to meet any of these parameters entitles customers to claims arising either from the contract or from legal provisions. These claims may take the form of contractual penalties for delayed property delivery, claims for price reduction due to discrepancies in area or property quality.

Claims against the developer can also have the nature of warranty claims described more extensively in the warranty claims section. If defects are present in the customer's property, they then have individual claims related to the presence of these defects. If the defects affect a common part of the building, the claims belong to the entire community.
